IACHR Urges States to Cease the Detention of Migrants

The Inter-American Commission on Human Rights (IACHR) has released its Annual Report, containing strong recommendations to states concerning the use of immigration detention.

The IACHR is a principal organ of the Organization of American States (OAS) whose mission is to promote and protect human rights in the American hemisphere.

In a thematic hearing before the Commission last year, the IDC led, along with over 160 members and partners, detailed the need for more knowledge on the use of immigration detention in the region and on positive practices from which to develop and strengthen alternatives to detention.

The IACHR responded to this request by including detention-focused questions in a survey that the IDC circulated and collated responses from members and partners across the region, the results of which can be seen in the IACHR annual report.

For the first time, the IACHR annual report has included a strong recommendation  that "all States in the region cease the detention of migrants as a general policy". It called for individual assessments, deeming immigration detention to be a harsh measure that is often "disproportionate in many, if not most cases".

The report also included a comprehensive amount of information on immigration detention in the Americas region, detailed in paragraphs 118 – 124 (Read more).
